By accessing or using the Elimu Track platform, mobile application, or associated services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These Terms apply to all schools, teachers, parents, and students who access the platform.

2. Description of Service

Elimu Track provides a comprehensive cloud-based school management system designed to facilitate academic grading, attendance tracking, financial management, and communication between educators and parents. We continuously update and improve the Service, and reserve the right to modify or discontinue features at any time without prior notice.

3. User Accounts and Responsibilities

• Account Security: You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• Data Accuracy: School administrators and teachers are responsible for the accuracy of the educational and financial data entered into the system. Elimu Track is not liable for errors originating from user input.
• Authorized Use: You agree to use the Service only for lawful educational and administrative purposes associated with your registered institution.

4. Prohibited Activities

When using Elimu Track, you agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of the software.
• Attempt to gain unauthorized access to other user accounts, school databases, or our servers.
• Upload or transmit viruses, malware, or any other malicious code.
• Use the platform to distribute spam or unsolicited communications.

5. Subscription and Payments

Access to the core features of Elimu Track requires an active subscription paid by the educational institution. Failure to pay subscription fees may result in the suspension or termination of access to the platform. All fees paid are non-refundable unless otherwise stipulated in a separate written agreement with the school.

6. Intellectual Property

The Service and its original content, features, functionality, and design are and will remain the exclusive property of Elimu Track and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Elimu Track.

7. Limitation of Liability

In no event shall Elimu Track, nor its directors, employees, or partners, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.
